Privacy Policy

1. Compliance With Laws. The Next Level Purchasing Association (NLPA) will comply with all laws related to telephone and email marketing, including anti-spam laws such as the CAN-SPAM Act of 2003, which allows for opting out of future communication.

2. Skills Assessments. Information provided to the NLPA for skills assessments (i.e., the PASS Program) will not be disclosed, distributed, published, disseminated, sold, traded, rented or shared with any third party unless such disclosure is so ordered by any court, administrative body, governmental agency or regulatory agency; or when the NLPA in good faith determines that it is legally required to make such disclosure; or when such disclosure is requested by law enforcement authorities in connection with their investigations; or in the event of an emergency. Such information will not be added to any list used by the NLPA to communicate marketing messages. Individuals participating in the PASS Program may also voluntarily sign up for basic membership in, or other programs from, the NLPA in which case they will receive communications applicable to the membership/program as a result of such additional registration and not as a result of their enrollment in the PASS Program.

3. The Next Level Purchasing Association. The information submitted when joining the Next Level Purchasing Association will not be disclosed, distributed, published, disseminated, sold, traded, rented or shared with any third party unless such disclosure is so ordered by any court, administrative body, governmental agency or regulatory agency; or when the NLPA in good faith determines that it is legally required to make such disclosure; or when such disclosure is requested by law enforcement authorities in connection with their investigations; or in the event of an emergency; or if the NLPA becomes a part of a legitimate, recognized federation of professional associations and such federation requires the ability to contact members of all associations that are part of the federation.

4. Sponsored Resources. The NLPA may, from time to time, promote resources, services, or events that are sponsored. In these cases, a separate registration process will be used and a privacy statement disclosing the sponsor’s access to those separate registration details will be provided. In no event will such sponsors be provided with the information of NLPA members who did not register separately for the resources, services, or events. In the event that material made available through the NLPA links to resources made available by third parties and those parties independently collect information or require registration, such information submission or registration details will be governed by the third party’s privacy policy and not that of the NLPA.

5. Third-Party Privacy Policies. In its sole discretion, the NLPA will reasonably attempt to advise members where a third party privacy policy applies. Where a NLPA resource has been made available through a third-party site, the use of information collected by or provided to that third party will be governed by that third party’s privacy party. Information collected on behalf of the NLPA by third party sites will not be added to any type of NLPA-managed broadcast mailing list unless specified. Notwithstanding the foregoing, the NLPA reserves the right to contact individuals who have obtained a NLPA-sponsored resource from a third party site when the NLPA believes that such individuals would benefit by learning about the NLPA’s services. The NLPA will promptly remove any individual from its contact list upon request.
